今日は憲法記念日です。 第98条を思い出してみよう： この憲法は、国の最高法規であつて、その条規に反する法律、命令、詔勅及び国務に関するその他の行為の全部又は一部は、その効力を有しない。 日本国が締結した条約及び確立された国際法規は、これを誠実に遵守することを必要とする。 日本政府や教育委員会が、人権条約を誠実に遵守することを学べますように期待しよう。

第24条: 教育 教育はCRPD（障害者の権利に関する条約）の不可欠な要素であり、第24条で取り上げられています。 以下は抜粋です。 締約国は、すべてのレベルにおいてインクルーシブな教育制度を確保するものとする… 障害を理由として、障害のある者が一般教育制度から排除されず、障害のある子どもが義務的かつ無償の初等教育や中等教育から排除されないことを確保すること； 障害のある者が、自らの生活する地域社会において、他の者と平等に、インクルーシブで質の高い無償の初等・中等教育を受けられるようにすること； 個々のニーズに応じた合理的配慮が提供されること； 一般教育制度の中で、障害のある者が効果的な教育を受けられるよう、必要な支援を受けられること； 完全なインクルージョンという目標に沿って、学業的及び社会的発達を最大限に引き出す環境の中で、効果的な個別支援措置が提供されること； この権利の実現を確保するために、締約国は適切な措置を講じ、教育のすべてのレベルで働く教師や専門家、職員を雇用・養成するものとする。その養成には、障害に関する認識を含め、適切な補助的・代替的な伝達方法、手段、形式、教育技術および教材の使用を含めるものとする； ...

アクセシビリティに関する一般的意見 2014年、障害者の権利に関する委員会は アクセシビリティに関する一般的意見第2号 を発表しました。 この文書は14ページしかありませんので、全文をお読みください。 日本語の仮訳・暫定版は こちら にあります。 他の条文との相互関係 学校へのアクセシブルな輸送機関や、アクセシブルな校舎、そしてアクセシブルな情報通信がなければ、障害のある人が教育を受ける権利（条約第24条）を行使する機会を持つことはない。 したがって、条約第9条第1項（a）に明確に述べられているように、学校はアクセシブルでなければならない。 しかし、アクセシブルでなければならないのは、インクルーシブな教育のプロセス全体であり、校舎だけではなく、環境支援システム又はFM支援システムを含む、学校におけるすべての情報通信、支援サービスと合理的配慮もアクセシブルでなければならない。アクセシビリティを促進するには、カリキュラム内容とともに、手話、点字、代替文字及び拡大代替コミュニケーションの形態、手段及び様式並びに歩行技能の習得が、教育において促進され、これらを用いた教育が実施されなければならず（第24条第3項（a））、その際、盲、ろう又は盲ろうの生徒が使用する、適切な言語並びにコミュニケーションの形態及び手段に、特別な注意を払うものとする。指導形態及び指導方法はアクセシブルでなければならず、アクセシブルな環境で実施されなければならない。障害のある児童生徒のすべての環境は、インクルージョンを促進し、教育のプロセス全体においてその平等が保障されるべく設計されなければならない。条約第24条の完全な実施は、他の中核となる人権法並びに国際連合教育科学文化機関の教育における差別待遇の防止に関する条約の規定と併せて検討されなければならない。
